Follow-Up on CBSE’s Response and Subsequent Actions under the RPwD Act, 2016

Dear Shri Rajesh Aggarwal Sir and Shri Praveen Ambashta Sir,
I hope this letter finds you well. I would like to express my sincere gratitude for your ongoing support regarding our petition for clarity from the CBSE on assessment protocols for students with Specific Learning Disabilities (SLD) in the 10th and 12th-grade examinations. Your proactive engagement has been invaluable and greatly appreciated.
However, despite your support, we have yet to receive a response from the CBSE. Over a year has passed since our petition was filed, and the essential clarifying circular for students with SLD, their families, and their schools is still pending. This circular is crucial for providing clear guidance on exam accommodations, ensuring that these students receive the necessary support to succeed.
It is disheartening that we had to file a petition with the CCPD just to request this clarification, and even more concerning that the issue remains unresolved after a full year. This situation highlights a significant systemic issue and raises concerns about the CBSE’s commitment to addressing the needs of students with disabilities.
Moreover, I am writing to follow up on your email dated August 9th, where CBSE was given a 10-day period to respond. It was mentioned that action would be initiated under Sections 78, 89, and 93 of the Rights of Persons with Disabilities (RPwD) Act, 2016, in case of non-compliance.
Though it was suggested considering legal action with the Kerala High Court, I would like to respectfully note that Section 93 of the RPwD Act specifies that complaints must be made by an aggrieved party or the CCPD. Given this, I would appreciate your guidance on the next steps and whether any actions have been initiated based on CBSE’s response or lack thereof.
The lack of response from the CBSE can be seen as an abuse of power, particularly since our request was for clarification, without means of enforcement. This situation leaves students and their families vulnerable. We seek your guidance on ensuring that the CBSE fulfills its responsibilities towards students with SLD.
If no new complaints have been raised this year, it should not be interpreted as satisfaction with the situation. Rather, it reflects a loss of hope and confidence in the system’s ability to address these issues. Ignoring this reality only further marginalizes students who need these accommodations the most.
I trust that your esteemed offices will continue to support us in navigating this situation. Your thoughts on how to proceed and the actions we can take to ensure that students with SLD receive the support they deserve would be greatly appreciated.
